Limited Warranty

Powerline Control Systems, Inc. (PCS) warrants to the Purchaser that products manufactured by PCS under the brand names (“Product”) sold in the USA will be free from defects in material and workmanship for a period of 5 years from the date of purchase. This limited warranty is extended to the original or first end user purchaser only and is conditional based upon proper storage, installation and use in accordance with Product specifications and instructions.

PCS’ obligation under this Limited Warranty is limited to the repair or replacement, at PCS’s option, of Product that fails due to defect in material or workmanship. PCS reserves the right to replace Product under this Limited Warranty with new or remanufactured product. PCS will not be responsible for labor costs of removal or reinstallation of Product. Warranty repairs or replacement can only be obtained by contacting PCS for a Return Merchandise Authorization (RMA) number and delivering or shipping the Product freight prepaid to: Powerline Control Systems, 19201 Parthenia St., Suite J, Northridge, CA 91324.

PCS will only be responsible for shipping costs of returning repaired or replacement Product to customer’s facility.

This warranty is not applicable to, and PCS makes no warranty whatsoever with respect to, any Product not installed and operated in accordance with the National Electric Code (NEC), the Standards for Safety of Underwriters Laboratories, Inc. (UL), Standards for the American National Standards Institute (ANSI) or, in Canada, the Canadian Standards Association (CSA). Nor is this warranty applicable to any Product

which has not been installed and operated in accordance with PCS' specifications and connection diagrams or Product which has been subjected to abnormal operating conditions as specified in PCS published literature.

The conditions for any tests performed on PCS’ Product which are claimed to have not performed in accordance with the terms of the warranty, shall be mutually agreed upon in writing and PCS may be represented at any such tests.

The repaired or replaced Product is then warranted under the terms of this Limited Warranty for the remainder of the Limited Warranty time period or ninety (90) days, whichever is longer.

THIS LIMITED WARRANTY DOES NOT COVER PC-BASED SOFTWARE PRODUCTS.

PCS is not responsible for conditions or applications beyond PCS' control. PCS is not responsible for defects or problems as a result of such conditions or applications. Such conditions include damage to Product while outside of PCS' possession, by its improper installation, including failure to follow written Installation and Operation Instructions, normal wear and tear, catastrophe, fault or negligence of the user, excessive system noise or attenuation or other problems external to the physical Product.

PCS MAKES NO EXPRESS WARRANTIES OTHER THAN THOSE EXPRESSLY SET FORTH HEREIN. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS, ARE LIMITED IN DURATION TO THE WARRANTY PERIOD SET FORTH ABOVE.

PCS will not be liable for consequential, incidental, special or exemplary damages, including, but not limited to, loss of profits, loss of use or damage to property or equipment, cost of capital, cost of substitute product, facilities or services, down time costs, labor costs, or claims of claimant’s customers, whether as a result of breach of contract, breach of warranty, tort, strict liability or otherwise. The foregoing limitations will apply even if any warranty or remedy provided under this Agreement fails of its essential purpose.

THE EXCLUSIVE REMEDY WITH RESPECT TO ANY AND ALL LOSSES OR DAMAGES RESULTING FROM ANY CAUSE WHATSOEVER SHALL BE REPAIR AND REPLACEMENT, AS SPECIFIED ABOVE. PCS SHALL IN NO EVENT BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES WHETHER BY NEGLIGENCE OR OTHERWISE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

THE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AND NO PERSON, (INCLUDING ANY AGENT, INTEGRATOR/DEALER OR REPRESENTATIVE OF PCS) IS AUTHORIZED TO MAKE ANY REPRESENTATION OR WARRANTY CONCERNING PRODUCT EXCEPT TO REFER ORIGINAL PURCHASER TO THIS LIMITED WARRANTY. ANY IMPLIEDWARRANTIES (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
